To the Finance Bureaus of all prefecture-level cities and above, the Finance and Taxation Bureau of Shunde District, the Finance Bureaus of counties (cities) directly under the provincial government, and all provincial departments:
In accordance with the "Notice of the Ministry of Finance on Improving the Budget Management of Government Procurement by Central Units and the Procurement Management of Scientific Instruments and Equipment by Central Universities and Research Institutes" (Cai Ku [2016] No. 194), to further improve the government procurement management of provincial-level fiscal scientific research projects and implement the requirements of the "Notice of the General Office of the Guangdong Provincial Committee of the Communist Party of China and the General Office of the Guangdong Provincial People's Government on the Implementation Opinions (Trial) on Further Improving the Management of Funds for Provincial-Level Fiscal Scientific Research Projects" (Yue Wei Ban [2017] No. 13), the relevant matters are hereby notified as follows:
I. Provincial universities and research institutes may procure scientific instruments and equipment independently. Provincial universities and research institutes may organize or entrust procurement agencies to procure various types of scientific instruments and equipment. Procurement activities shall be carried out in accordance with the provisions of government procurement laws and regulations.
II. A filing system shall be implemented for the procurement of imported scientific instruments and equipment by provincial universities and research institutes. Provincial universities and research institutes procuring imported scientific research instruments and equipment should conduct expert reviews as required. Experts participating in the reviews can be selected independently, and their opinions should be archived with the procurement documents for future reference. Provincial universities and research institutes can directly file their government procurement plans after uploading expert reviews and expert lists to the Guangdong Provincial Department of Finance's online government procurement system. If the same imported product has already been filed within the same budget year, provincial universities and research institutes do not need to conduct repeated expert reviews for subsequent purchases; they can directly file their government procurement plans with the original expert reviews attached. According to the "Opinions of the General Office of the Guangdong Provincial People's Government on Further Deepening the Reform of the Government Procurement Management System" (Yuebanhan [2015] No. 532), for products listed in the imported product list under the "Opinions of the General Office of the Guangdong Provincial People's Government on Further Deepening the Reform of the Government Procurement Management System," provincial universities and research institutes do not need to provide expert reviews for products listed in the imported product list; they can directly file their government procurement plans.
III. Accelerate the approval process for changes in the government procurement method for scientific research instruments and equipment by provincial universities and research institutes. When applying to change the government procurement method, provincial universities and research institutes can specify "scientific research instruments and equipment," and the finance department will give priority to approval. For procurement projects of goods and services that meet the threshold for open bidding and are intended to be procured through non-bidding methods, the procuring entity shall comply with the provisions of the "Administrative Measures for Non-Bidding Methods of Government Procurement" (Ministry of Finance Order No. 74).
IV. Provincial universities and research institutes may independently select review experts for scientific research equipment procurement. Provincial universities and research institutes may independently select review experts outside the government procurement review expert database for scientific research equipment procurement. If the independently selected review experts have a conflict of interest with the suppliers, the relevant avoidance regulations shall be strictly enforced. After the review activity is completed, provincial universities and research institutes shall mark the self-selected review experts in the list of review experts and announce the results along with the winning bid and transaction results.
V. In accordance with the "Opinions of the General Office of the Guangdong Provincial People's Government on Further Deepening the Reform of the Government Procurement Management System" (Yuebanhan [2015] No. 532), the procurement of equipment included in the Guangdong Provincial High-Level University Scientific Research Equipment Dynamic Project Database shall continue to be implemented in accordance with the relevant provisions of the Guangdong Provincial High-Level University Scientific Research Equipment Dynamic Project Database Management Measures.
VI. Strengthen internal control management of scientific research equipment procurement. Provincial universities and research institutes should, in accordance with the "Guiding Opinions of the Ministry of Finance on Strengthening Internal Management of Government Procurement Activities" (Cai Ku [2016] No. 99), further improve their internal management regulations, strengthen internal control management of scientific research equipment procurement, strictly implement relevant government procurement regulations, and proactively disclose relevant government procurement information to ensure full openness, transparency, and traceability in the procurement of scientific research equipment.
The finance departments of prefecture-level cities and above may refer to the spirit of this notice and, in light of local conditions, improve their relevant management regulations.
